These terms are legally binding. If you do not agree with any provision, do not make a purchase or request a commission.
Goth Moth Rebellion Studios is a small, independent studio operated by one artist. Every piece that leaves our hands has been made with intention, skill, and care. These terms exist to protect both you and us, and to ensure every transaction is clear, honest, and straightforward from the start.

## 1. ABOUT OUR PRODUCTS & HANDMADE ARTWORK
### 1.1 One-of-a-Kind Handmade Items
Every item sold through Goth Moth Rebellion Studios is handmade and one of a kind. No two pieces are identical. Variations in color, texture, dimension, finish, and overall appearance are not defects - they are the defining characteristic of original, hand-crafted artwork.
### 1.2 Product Photography & Representation
Product photography is as accurate as possible under studio lighting conditions. Slight differences between the image and the physical piece are inherent to handmade goods and are not grounds for return, exchange, or dispute. Lighting, camera settings, screen display, and monitor color calibration can all affect how an image appears online versus in person.
Colors, textures, and appearance may vary slightly due to:
- Differences in monitor/screen display
- Natural variation in materials (gemstones, metals, fabrics, wax)
- Handmade craftsmanship

## 2. ALL SALES ARE FINAL - NO RETURNS, EXCHANGES, CANCELLATIONS, OR REFUNDS
We do not accept returns, exchanges, cancellations, or refunds once an order has been placed and payment has been processed. This applies to all ready-to-ship items, apparel, candles, and all commission work, without exception.
Because each piece is made by hand - often made specifically for you - it cannot be restocked or resold. Your purchase is final. If you have any hesitation before ordering, please contact us before completing your purchase. We are responsive and happy to answer questions.

## 3. SHIPPING & DELIVERY
### 3.1 Shipping Locations & Restrictions
Goth Moth Rebellion Studios ships within the United States only. We do not offer international shipping and do not ship to PO boxes, APO addresses, or any address outside the continental United States.
Orders placed with a non-US shipping address will be cancelled and refunded.
### 3.2 Processing & Dispatch Times
- Ready-to-ship items are typically dispatched within 3–7 business days of purchase
- Commission pieces ship after completion, per the timeline agreed upon at booking
- Processing times may be longer during high-volume periods, seasonal demand, or personal circumstances
- We will communicate any significant delays proactively, but delays do not obligate us to refund or expedite
### 3.3 Shipping Methods & Carriers
We ship via USPS, UPS, FedEx, or comparable carrier depending on package size and weight. Tracking information will be provided once your order ships. Delivery timelines are estimates provided by the carrier and are not guaranteed by us.
Standard delivery: 5–10 business days after shipment (estimates only)
### 3.4 Lost or Damaged Shipments in Transit
Once an order leaves our studio and is in the carrier's possession, we are not responsible for delays, loss, or damage in transit.
If your package arrives damaged:
1. Document the damage immediately with photos of the packaging (interior and exterior) and the item
2. Contact us within 48 hours of delivery with photos and order number
3. We will investigate and may file a carrier claim on your behalf
Resolution depends on carrier investigation and insurance; this process may take 30+ days. We are not liable for lost packages. You assume shipping risk once an order leaves our facility.

## 4. PRODUCT CARE & MAINTENANCE
### 4.1 Jewelry Care Requirements
All jewelry from Goth Moth Rebellion Studios requires specific care to maintain quality and longevity.
Water & Moisture:
- DO NOT submerge, shower, or bathe with jewelry on
- Wire-wrapped pieces contain fine silver wire, which oxidizes and weakens when exposed to water
- Moisture accelerates tarnishing and can compromise structural integrity
- Remove jewelry before swimming, bathing, washing hands, or any water exposure
Storage:
- Store in a cool, dry place away from humidity
- Use a soft cloth or jewelry pouch to prevent tangling and scratching
- Keep away from direct sunlight, heat, and temperature fluctuations
- Store away from perfumes, lotions, and chemical products
Handling:
- Handle gently; wire can bend or break under pressure
- Avoid dropping or striking against hard surfaces
- Do not sleep in wire-wrapped jewelry (risk of bending or breakage)
Cleaning:
- Clean gently with a soft, dry cloth only
- Do not use commercial jewelry cleaners, polishes, or ultrasonic cleaners
- For stubborn tarnish, consult the care instructions included with your item
No Warranty: Products are sold as-is. We make no warranties regarding durability, longevity, or performance under conditions outside of recommended care. Damage resulting from improper care, water exposure, or misuse is not covered by any repair or replacement policy.
### 4.2 Apparel Care Requirements
Apparel should be cared for according to the included care tag instructions. We are not responsible for damage resulting from improper washing, drying, storage, or use.

## 5. CUSTOM COMMISSIONS - TERMS & CONDITIONS
### 5.1 Commission Acceptance Is Entirely at Our Discretion
We accept commissions entirely at our sole discretion. Submitting a commission request, inquiry, or proposal does not guarantee a booking or acceptance.
We reserve the right to decline any request for any reason, including (but not limited to):
- Timeline conflicts or current workload
- Skill fit (the project falls outside our artistic skillset or comfort zone)
- Subject matter or creative direction
- Capacity or personal circumstances
- Any other reason we deem appropriate
We will be transparent with you. If a project is outside our skillset or wheelhouse, we will tell you. We do not accept work we cannot execute well, and we will not promise results we cannot confidently deliver. Your satisfaction depends on clear expectation-setting from the start.
### 5.2 Workload, Capacity & Timeline Variability
Commissions are only opened when we have the time, energy, and skill to execute them properly. We do not rush our work, and we do not overbook.
Timeline variability is inherent to this business. Commission timelines are not guaranteed and may vary significantly based on:
- Current workload and other active projects
- Personal circumstances, health, or capacity
- Complexity of the project as work progresses
- Artistic priority and creative energy allocation
Projects with significant artistic freedom are heavily preferred and may take precedence over other commissioned work in the creation schedule. However, this is not always the case - priority depends entirely on our current caseload and creative judgment as a one-person studio.
You understand that you are commissioning from one artist with finite time and energy. Timelines provided are estimates, not guarantees. We will communicate updates if a project will take longer than initially estimated, but we will not rush or compromise quality to meet an original deadline.
### 5.3 Commission Pricing & Estimates
Prices for custom-commissioned work vary and are subject to change. Each piece is priced individually based on:
- Materials cost (fine silver, gemstones, wire gauges, findings, specialty materials)
- Complexity & design difficulty (intricacy of wrapping, number of elements, custom specifications)
- Time investment (design consultation, creation, revisions, quality control)
- Materials sourcing (travel, out-of-state procurement, specialized suppliers)
- Market conditions (material price fluctuations, precious metals pricing, tariffs, taxes)
Initial estimates are provisional only and based on best-known material costs and sourcing at the time of quote.
Estimates are valid for 7 days. If you do not secure the commission within this window, we may need to re-quote based on current material costs and market conditions.
The final invoice may differ from the estimate if:
- Material costs have shifted (precious metal pricing, gemstone availability)
- Tariffs or taxes have changed
- Materials require out-of-state travel or specialized sourcing beyond initial expectations
- Design complexity requires more or less time than estimated
- Market conditions have changed significantly
You will be notified of any material price increases before work begins; final estimate and timeline will be confirmed in writing.
### 5.4 Non-Refundable Retainer (Upfront, Separate Cost)
- A non-refundable retainer is required to begin work - collected before design consultation starts
- Retainer amount: typically 50% of the initial estimate (or as agreed)
- The retainer is a separate, distinct cost and does not reduce the final invoice
- Retainer secures your spot in the production queue and covers design consultation time
- Work does not begin until payment (or deposit) is received and confirmed
### 5.5 Out-of-Pocket Expenses & Additional Charges
Customer acknowledges and agrees that all reasonable out-of-pocket expenses incurred in the production of commissioned work shall be added to and included in the final invoice. Out-of-pocket expenses include, but are not limited to:
- Materials sourcing and procurement costs - including travel expenses, gas, mileage, shipping fees, and time spent acquiring specialized or custom materials from suppliers outside the immediate service area
- Out-of-state travel expenses - including mileage reimbursement at standard federal rates, fuel, tolls, and parking for travel required to obtain materials unavailable locally
- Specialized material fees - premium pricing for rare gemstones, specialty wire gauges, or materials requiring expedited or custom orders
- Shipping and handling of materials - cost of shipping materials to the studio, insurance on high-value materials, and customs fees (if applicable)
- Applicable taxes and tariffs - federal, state, or local taxes; import tariffs; or duty fees on materials
All out-of-pocket expenses shall be documented and provided to the customer with itemized receipts or invoices as part of the final billing statement. The customer's retainer and initial estimate do not cover or offset these expenses; they represent additional costs due upon final invoice and before item shipment.
By accepting a commission quote and paying the non-refundable retainer, the customer authorizes Goth Moth Rebellion Studios to incur reasonable out-of-pocket expenses on their behalf and agrees to reimburse these expenses as invoiced.
### 5.6 Final Results May Vary - Artistic Interpretation
Your commissioned piece may look different from what you initially envisioned. This is not a defect or failure; it is the nature of commissioning original art from a real artist.
Your creative request will be interpreted through our artistic skillset, style, and creative vision. The final result may differ from the reference image, inspiration, or description you provide due to artistic interpretation and creative choice.
You are commissioning original art, not a photorealistic copy. We will create something beautiful and thoughtful, but it will be our interpretation based on our skills and vision. If you require a piece that looks exactly like a reference image or specific style, we may not be the right artist for your project, and we will tell you that upfront.
### 5.7 No Duplicates or Precise Recreations Guaranteed
We do not guarantee the ability to recreate a previous piece, even if you are requesting something "just like" an earlier work. Handmade art cannot be precisely duplicated.
Each commission is its own creation. If you are requesting something that closely resembles a previous piece, we will do our best to capture the spirit and essence of it, but an exact duplicate is never promised and should never be expected.
### 5.8 No Revisions, Redos, or Refunds
Commission work is created based on the brief, references, and creative direction provided at the time of booking and during initial consultation.
We do not offer revisions, major reworks, redos, or refunds once a commission is underway or completed. It is your responsibility to:
- Provide clear, complete references and creative preferences before work begins
- Communicate your vision and expectations during the initial consultation
- Ask clarifying questions and voice concerns before we begin creation
We will confirm the scope, timeline, and creative direction with you in writing prior to starting work. This confirmation is your opportunity to ensure alignment. Once confirmed and work begins, the creative direction is locked.
Minor corrections related to our execution error (e.g., a significant technical flaw) may be considered, but cosmetic preferences, style changes, or dissatisfaction with the artistic interpretation are not eligible for revision.
### 5.9 Commission Cancellation
- Commissions cannot be cancelled after work has begun
- If you request cancellation before work starts, your retainer is forfeited
- If you do not pay final balance (including out-of-pocket expenses), the completed piece will not be shipped and your retainer is retained as compensation for materials and time invested

## 6. REPAIRS & ALTERATIONS - DISCRETIONARY & CONDITIONAL
### 6.1 Repair Requests Are Discretionary, Not Guaranteed
We care about the longevity of our work, and we will always consider repair requests on a case-by-case basis. However, repairs are not guaranteed.
We reserve the right to decline any repair request at our sole discretion, including (but not limited to) if:
- The piece has been significantly altered or modified after purchase
- The piece is heavily damaged or no longer something we can responsibly repair
- The damage falls into our exclusion categories (see Section 6.2)
- We determine the repair is beyond our scope or skill
### 6.2 What Is NOT Covered Under Any Circumstance
The following are not eligible for repair consideration under any circumstance:
- Damage resulting from normal wear and tear
- Misuse, rough handling, or improper care
- Improper storage or environmental exposure
- Accidental damage caused by the customer or any third party
- Modifications, alterations, or customization made to the piece after purchase
- Water damage, heat damage, humidity damage, or chemical exposure
- Fading, discoloration, or patina that occurs naturally over time
- Damage from improper care, water exposure, or misuse
If a piece has been damaged through any of the above, we will decline the repair request. This is not negotiable. You are responsible for the care and maintenance of your artwork after purchase.
### 6.3 Simple Repairs (At Our Discretion)
Simple repairs (retightening stones, minor adjustments): typically free if returned within 30 days of purchase.
### 6.4 Complex Repairs & Cost Responsibility
If a complex repair is approved at our discretion:
- Complex repairs (replacing broken wire, re-wrapping sections, sourcing materials): cost estimate provided; customer pays shipping both ways
- Out-of-warranty repairs (damage from improper care, water exposure, misuse): full cost billed to customer plus return shipping
- You are responsible for 100% of shipping costs to send the item to us, including packaging, postage, insurance (if you choose it), and any carrier fees
- We recommend tracking and insurance on all inbound shipments. We are not responsible for items lost, damaged, or delayed in transit to our studio
- Return shipping costs and terms will be discussed and agreed upon at the time of the repair agreement, not after we receive the item
- Material costs are volatile; if fine silver pricing changes significantly, repair quotes may need adjustment
### 6.5 Repair Turnaround & No Guarantees
- Repairs are processed in order received
- Typical turnaround: 2–4 weeks (longer for complex work or high volume)
- You will be contacted with cost estimate before work begins
- Once approved, item ships back to you within 5–10 business days of completion
- There is no guarantee that a repair, if undertaken, will restore the piece to its original condition
### 6.6 Non-Repairable Items
Items deemed non-repairable will be returned at no charge for repair labor, but customer pays return shipping. A brief explanation of why repair is not feasible will be provided.

## 7. HEALTH & SAFETY - QUESTIONNAIRE, ALLERGIES & ASSUMPTIONS
### 7.1 Required Information for Jewelry & Apparel
For all jewelry and apparel purchases, we collect information about:
Jewelry & Materials:
- Known allergies and sensitivities to metals, including: fine silver, brass, pewter, aluminum, Tibetan silver, stainless steel, nickel, zinc, copper, gold-plated, silver-plated, and other metal alloys
- Sensitivities to gemstones, crystals, glass, resin, or other components used in jewelry
- Latex and rubber sensitivities (including natural rubber latex and synthetic rubber)
- Sensory sensitivities or concerns
Apparel & Fabrics:
- Known allergies or sensitivities to cotton, rayon, polyester, and other natural or synthetic fabrics
- Sensitivities to elastic, zippers, snaps, buttons, or hardware that may contain nickel or other metals
- Latex or rubber sensitivities (including rubber elastics and rubber components)
- Sensory sensitivities to textures or materials
General Health:
- Any other relevant health considerations, medical conditions, or concerns
- Skin conditions, eczema, dermatitis, or sensitive skin
This information is essential to ensure you receive products that are safe for you. Providing complete and accurate information is your responsibility.
### 7.2 Your Responsibility
- You are responsible for providing accurate and complete information about known health needs and allergies
- If you provide false or incomplete information and experience an adverse reaction, we are not liable
- If your circumstances change (new allergy, sensitivity discovered), inform us before wearing or using the item
- You must patch-test all jewelry before extended wear by wearing the item for short periods (2–4 hours initially) on a less-sensitive area of skin
- Monitor for any signs of irritation, rash, itching, or discomfort during and after wear
- Discontinue use immediately if any adverse reaction occurs
- For apparel, follow care instructions and test for comfort before extended wear
### 7.3 What We Do With This Information
- We use questionnaire responses solely to recommend safe materials and designs
- We do not share this information with any third parties
- We discard this information after order fulfillment unless repair or commission follow-up is needed
### 7.4 Assumption of Risk for Allergies & Sensitivities
Materials Used:
Goth Moth Rebellion Studios uses multiple metal and material components in jewelry and apparel, including but not limited to:
Metals: fine silver, brass, pewter, aluminum, Tibetan silver, stainless steel, nickel, zinc, copper, gold-plated, silver-plated, and other metal alloys
Other Components: gemstones, crystals, glass, resin, wood, leather, rubber, latex, and other natural and synthetic materials
Apparel Fabrics: 100% cotton, cotton-rayon-polyester blends, and other fabric compositions. Some items may contain elastic, zippers, snaps, buttons, or hardware that may contain nickel or other metals.
Acknowledgment of Risk:
Customer acknowledges that:
- Metal allergies can develop or be discovered for the first time during or after wearing jewelry or apparel
- Latex and rubber allergies can develop or be discovered for the first time during or after contact with the product
- Fabric sensitivities and allergic reactions can develop or manifest unexpectedly
- Some individuals may have unknown sensitivities or intolerances to specific materials that have not previously been identified
- Goth Moth Rebellion Studios cannot test for or predict unknown allergies or sensitivities
- Customer is solely responsible for determining their own tolerance to the materials used in their items
Customer's Responsibility:
- Patch-test all jewelry before extended wear by wearing the item for short periods (2–4 hours initially) on a less-sensitive area of skin
- Test all apparel for comfort and fit before extended wear, and observe for any signs of irritation
- Monitor for any signs of irritation, rash, itching, discomfort, or adverse reactions during and after wear
- Discontinue use immediately if any adverse reaction occurs
- Seek medical attention if a reaction persists or worsens
- Do not wear the item if irritation develops, even if no allergy was previously known
- Provide accurate and complete health information via the questionnaire
- Disclose any known sensitivities to specific fabrics, dyes, latex, rubber, or materials
Goth Moth Rebellion Studios is NOT liable for:
- Allergic reactions, contact dermatitis, rashes, hives, urticaria, or skin conditions resulting from wearing jewelry or apparel
- Latex allergy reactions (including mild contact reactions, localized rashes, or severe anaphylaxis) that result from contact with jewelry components, clasps, or apparel elastics
- Rubber allergy reactions resulting from rubber or synthetic rubber components
- Unknown or previously undetected metal allergies or fabric sensitivities that manifest during or after wear
- Reactions that occur because the customer did not patch-test, follow care instructions, or ignored signs of irritation
- Illness, injury, infection, skin conditions, dermatitis, eczema, or other reactions arising from wearing the item
- Medical expenses, lost wages, lost productivity, pain and suffering, emergency care costs, or other damages resulting from allergic reactions or adverse health events
- Reactions to materials listed in product descriptions or care instructions
- Pre-existing conditions exacerbated by wearing or using the item
- Reactions to dyes, finishes, or processing residues on new apparel or materials
By purchasing jewelry or apparel from Goth Moth Rebellion Studios, Customer accepts full responsibility for testing the item, following care instructions, and discontinuing use if any reaction occurs.

## 8. CANDLES & FIRE SAFETY
### 8.1 Fire Hazard Warning
All candles sold by Goth Moth Rebellion Studios are handmade products that carry inherent fire hazards. Each candle is labeled with a fire hazard sticker on the bottom of the container.
CANDLES ARE NOT TOYS. THEY ARE FIRE HAZARDS.
### 8.2 Candle Care & Safety Instructions
Customer assumes full responsibility for the safe use, placement, and supervision of all candles. Customer acknowledges and agrees to:
- Never leave a burning candle unattended at any time
- Keep candles away from children, pets, and flammable materials (curtains, bedding, paper, cloth, etc.)
- Trim the wick to ¼ inch before each burn to prevent excessive smoking and flaring
- Burn candles on a stable, heat-resistant, and level surface away from drafts, fans, or air vents
- Keep candles away from windows, air conditioning, heating vents, and oscillating fans which can cause uneven burning or blow out the flame
- Never move a burning or recently-extinguished candle
- Blow out candles before leaving the room or before going to sleep
- Never use candles as a light source during power outages or emergencies
- Stop burning a candle when ½ inch of wax remains to avoid overheating the container
- Keep candles out of the reach of children and pets
- Assume full responsibility for proper candle placement in your home; you know the layout, risks, and people in your space
### 8.3 Assumption of All Fire Risk
Customer assumes 100% responsibility for all fire, burn, smoke, and property damage risks once the candle is purchased and leaves our facility.
### 8.4 Goth Moth Rebellion Studios is NOT Liable For
- Any fire, burn, or smoke damage resulting from candle use
- Improper storage, placement, or supervision of candles
- Customer failing to follow safety instructions or ignoring warnings
- Candles left unattended or burning longer than intended
- Candles placed near flammable materials
- Candles used by children or pets without direct adult supervision
- Damage caused by customer negligence or failure to follow care instructions
- Property damage from fire or smoke, regardless of cause
- Medical expenses, loss of property, or other damages resulting from improper candle use
- Any incident that occurs after the candle leaves our facility
### 8.5 Right to Refuse Sale
We reserve the right to refuse the sale of candles to any customer who we believe will not use them safely or who demonstrates that they do not understand fire safety.

Violation of these restrictions may result in legal action.

Purchasing a physical piece grants you ownership of that specific object only. It does not transfer:
- Copyright or intellectual property rights
- Reproduction rights
- Commercial usage rights
- The right to create derivatives or modify the piece
- The right to display the work publicly or in commercial contexts
The piece is yours to keep, display in your home, gift, or resell as a physical object. It is not yours to copy, reproduce, or commercialize.
Custom commissioned designs are created for your personal use only. You may not reproduce, copy, recreate, or share detailed photos of the design publicly without crediting Goth Moth Rebellion Studios.

For commission work:
- A non-refundable deposit is required to secure your booking and reserve your slot
- Deposit amounts and payment schedules are confirmed in your commission agreement
- Work does not begin until payment (or deposit) is received and confirmed
- Remaining balance is due per the payment schedule outlined in your agreement
### 12.3 Currency & Fees
